Please read this Agreement carefully before using the materials provided in this software release. By using the materials in this software release ("the Software"), you are agreeing to be bound by the terms of this Agreement.
1. Software License Grant
A. Subject to the licensee's compliance with the terms and conditions of this Agreement, Cogco International Limited ("Cogco") hereby grants to Licensee, a personal nonexclusive right and license to use the Cogco software, documentation and related information provided in this release. The Licensee agrees not to disassemble, decompile, copy, modify, translate, reverse-engineer, render into human readable form, or create derivative works from the Software and its associated data files.
Free Trial Period
The Software will cease to function after certain number of launches. After this period, you are required to purchase a paid-for license from Cogco if you wish to continue using the Software. Cogco reserves the right to extend, reduce or withdraw the free-trial period. The licensee agrees not to alter the Software in any way that permits use beyond the free-trial period without payment of the paid-for license fee to Cogco. On application to Cogco, Cogco may at its discretion permit longer trial periods to individual licensees.
You may only install this software on as many computers as you hold paid-for licenses to the Software. You may make one of the Software copy for archival or backup purposes. You may transfer the software on a permanent basis to a third party only after written notice to Cogco.
B. THE SOFTWARE SHALL NOT BE USED UNDER CIRCUMSTANCES WHERE THE FAILURE OF THE SOFTWARE COULD LEAD TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE.
2. Proprietory Notices
The licensee agrees not to alter, remove or obscure any copyright notices or other proprietory notices on and in the Software.
3. LIMITED WARRANTY
If the Software has been provided on physical media (CDROM or floppy disk) by Cogco, that original media is warranted to be free from defects for a period of sixty days following the delivery of the Software to you. Within the period of the warranty you may return the media to Cogco for replacement. Cogco does not warrant that the Software will meet your requirements or that the operation of the Software will be uninterrupted or that the Software will be free from errors.
The above warranty is exclusive and in lieu of all other warranties, whether express or implied, including the implied warranty of merchantability and fitness for a particular purpose. This does not affect your statutory rights.
4. DISCLAIMER OF LIABILITY
COGCO WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, WETHER ARISING IN TORT (INCLUDING NEGLIGENCE), CONTRACT OR OTHERWISE, THAT STEM FROM ANY USE OF THE SOFTWARE AND/OR OTHER INFORMATION PROVIDED BY COGCO.
5. GOVERNING LAW
This Agreement will be governed by the laws of England.
